Albuquerque: the state floor overrides a lower city calculation

The city’s 2026 notice calculates an $11.85 local minimum but expressly identifies the state’s $12 as controlling. Its healthcare/childcare-credit calculation also cannot lower the applicable floor below $12. Eligible tipped cash is $7.20. At 40 hours and $200 tips, the worker receives $288 employer cash plus tips, for $488 gross. 2026 official notice.

City Council passed a further wage measure in June 2026. The enacted O-2026-018 sets $13 from January 1, 2027 and eligible tipped cash at 55.5% of the city floor. That is $7.215 per hour before weekly payroll rounding; this form applies both dated changes. The benefits-credit exception remains outside this ordinary no-benefit-credit scope. Council announcement.

Las Cruces has a weekly tipped-employee threshold

The 2026 city notice defines a tipped employee by customary tips above $30 per week and counts tips actually retained and reported for FICA purposes. That is a weekly threshold, while the state manual describes a $30 monthly threshold. Confirm both applicable requirements before choosing the credit. City notice and coverage.

Forty hours at $5.20 cash gives $208 before adjustment. With $200 tips, the employer adds $112.40, producing $520.40 combined gross. For 45 hours and $400 tips, cash with the overtime premium is $266.53 and gross is $666.53.

Santa Fe city and county are separate jurisdictions

The county ordinance covers specified employers outside Santa Fe city, Española and Edgewood. Its tipped base is 30% of its living wage: $4.50 in January–February 2026 and $4.62 from March. City eligible tipped cash remains subject to the state $3 floor, with the city’s separate customary-tip threshold. County boundaries, rates and exemptions.

The city poster uses more than $100 monthly in tips or commissions for its credit provision. This model requires more than $100 in tips and includes no commissions, benefit credits or Medicaid-funded nonprofit exception. A postal address alone does not establish city coverage. City 2026 posting.

For 40 March hours and $200 tips, both ordinary scenarios reach $616 gross, but the cash ledger differs: city initial cash $120 plus $296 adjustment; county initial cash $184.80 plus $231.20 adjustment. In January, the full floor was $15 and the same week reached $600. City prior rate; County prior rate.

The next Santa Fe city increase has a future effective date

The city lists $17.50 beginning January 1, 2027. That amount is not the October 2026 floor, and the city announcement does not establish the county’s next rate. The form applies the city’s $17.50 floor and $3 eligible tipped cash from January 2027. The county separately retains its March schedule through February 2027, then requires its own actual published new amount. The city’s next blended annual adjustment begins in March 2028. Weekly overtime and annual gross

For ordinary covered work, a 45-hour full-cash week at the state $12 floor gives $570; at Santa Fe’s March $15.40 floor it gives $731.50. The calculator assumes one workweek, one jurisdiction and one rate period, with no bonuses, deductions or exemption. NMDWS overtime guidance.

At 40 hours repeated for 52 weeks, gross is $24,960 at the state floor, $27,060.80 in Las Cruces and $32,032 at the Santa Fe March rate. The last scenario repeats that rate for comparison; it is not an exact January–December total because the Santa Fe floor changed during the year.
