Overtime uses the full regular rate before subtracting a permitted tip credit. The employer must cover a weekly tip shortfall within the selected scope. This floor scenario does not calculate pay at a higher agreed rate. Per-workday pay divides the week by the days with hours. Annual figures repeat the rounded weekly result.

Reviewed rate period: 2026-01-01 through 2027-12-31. Gross earnings before taxes or deductions. Annual figures repeat this weekly scenario; they do not combine different rate periods.

The 2027 increase is enacted, not an inflation estimate

The 2026 amendments set the $13.75 and $15 steps in law. Under the current schedule, annual inflation adjustments resume for January 2029. Older summaries describing only an annual index do not capture these intervening increases. The tool does not apply the 2027 rate to work performed in 2026. §40.1-28.10(B)–(F).

Full-cash scenario2026 at $12.772027 at $13.75
40-hour week$510.80$550.00
45 hours with ordinary federal overtime$606.58$653.13
40 hours for 52 weeks$26,561.60$28,600.00

The annual comparison assumes the same schedule for 52 weeks at one rate. A workweek crossing January 1 requires both rates and a combined overtime calculation; this single-rate weekly tool does not handle that transition week.

The employer must restore a low-tip week to the Virginia floor

DOLI permits $2.13 cash for eligible federally covered tipped employees, with wages plus tips reaching Virginia’s higher floor. At 40 hours and $300 tips, initial employer cash is $85.20. The employer adjustment is $125.60 in 2026 or $164.80 in 2027, giving $510.80 or $550 combined gross. DOLI cash-wage and shortfall guidance.

The corresponding maximum credit in this floor model is $10.64 per hour in 2026 and $11.62 in 2027. At 45 hours and $600 retained tips, employer cash including the ordinary overtime premium is $127.78 or $130.23. Total gross is $727.78 or $730.23. The premium starts with the full regular rate, and the credit is not multiplied by 1.5. Federal tipped overtime method.

Tip eligibility requires more than a gratuity on a receipt

Virginia defines a tipped employee using customary tips above $30 per month. It also prohibits treating someone as tipped when applicable law or regulation prohibits that person from soliciting tips. Confirm both eligibility and lawful retention or pooling before selecting the credit; compulsory service charges do not belong in the voluntary-tip input. §40.1-28.9 tipped definitions.

Virginia minimum-wage coverage does not settle overtime coverage

Virginia’s overtime-liability provision uses FLSA coverage, exemptions and calculation methods. The federal option requires ordinary nonexempt coverage. The state-only full-cash option is for confirmed absence of a federal overtime obligation; it does not infer that absence from employer size. §40.1-29.2 · Federal coverage.

For 45 hours, the 2026 state-only full-cash scenario is $574.65, compared with $606.58 when ordinary overtime applies. In 2027 those figures are $618.75 and $653.13. A higher agreed regular rate, bonus or multiple-rate week needs a different calculation.

Use the definition in effect on the work date

The official definitions page contains separate versions for 2026, January 2027 and July 2030. The farm-worker exclusion appearing in the 2026 version is removed in the January 2027 version. This calculator excludes agriculture, so the ordinary scenarios do not imply coverage for a farm job before its effective change. Dated statutory versions.

Approved training programs and other exceptions also require their own review. The calculation here assumes adult ordinary coverage at the full floor, with no credits for meals or lodging. Training provision in §40.1-28.10(A).
