Overtime uses the full regular rate before subtracting a permitted tip credit. The employer must cover a weekly tip shortfall within the selected scope. Choose coverage before calculating overtime

An employer’s size alone does not settle federal coverage: an employee can be individually covered through the work performed even when the business does not meet enterprise coverage criteria. Do not select state-only treatment simply because a business is small. The calculator’s state-only option requires confirmed coverage at the $7.25 state floor and confirmed absence of a federal overtime obligation. Enterprise and individual coverage.

Worked hoursFederal ordinary overtimeConfirmed state-only full cash
40$290.00$290.00
45$344.38$326.25
50$398.75$362.50

These are floor scenarios. An agreed $12 hourly wage cannot be replaced with $7.25 when calculating wages owed. Special exemptions, contract wage schedules and jobs outside the state act require a separate review. A salary label alone also does not establish a federal overtime exemption. Oklahoma changed its state tip-credit law in November 2025

Older summaries describe a state credit limited to half of the minimum wage. Senate Bill 250 became law without the governor’s signature on May 26, 2025 and amended §197.16 effective November 1, 2025, replacing that limit with a cash floor tied to 29 CFR §531.50(a)(1). Check the enacted amendment before using an old state tipped-wage table. SB 250 enactment history · Enrolled amendment and effective date.

The tool’s tipped option models federally covered work: $2.13 employer cash plus a maximum $5.12 hourly credit. It requires an eligible tipped occupation, advance notice and lawful retention or pooling. State-only treatment here uses full cash; it does not determine state-only credit eligibility or combine tips with meal and lodging allowances. Federal tipped-worker requirements.

A low-tip week still needs employer cash

At 30 hours with $90 retained tips, initial employer cash is $63.90. The employer must add $63.60 to reach $217.50 combined gross. At 45 hours with $300 tips, employer cash is $113.98 and combined gross is $413.98. Overtime uses the full regular rate before subtracting the credit; multiplying $2.13 by 1.5 would understate the premium. Tip shortfalls and overtime.

Pay frequency and final pay are separate from hourly rates

Oklahoma ordinarily requires nonexempt workers to be paid at least twice each calendar month. Exempt and state, county and municipal employees can be paid at least monthly. When employment ends, the regular payday for the relevant pay period generally controls; the last shift is not automatically the payment deadline. Annual pay assumes the same schedule throughout

Forty hours for 52 weeks gives $15,080 before tax, averaging $1,256.67 per month. Thirty hours for 48 weeks gives $10,440. Enter actual working weeks instead of assuming paid leave or year-round employment. The result is earnings, not take-home pay or a rent-affordability assessment.
