Use the published $4.86 tipped cash floor
The state order limits the tip credit to 33% of minimum wage; the agency translates this to $4.86 cash at today’s floor. This model uses that published cash amount rather than paying a fractional-cent rate below it. The worker must perform qualifying direct customer service and customarily receive more than $30 monthly in tips. Cooking and dishwashing do not become eligible simply because the workplace receives tips. Agency tipped-worker guidance.
| Scenario | Initial employer cash | Employer shortfall | Gross with tips |
|---|---|---|---|
| 40 hours, $80 tips | $194.40 | $15.60 | $290 |
| 40 hours, $200 tips | $194.40 | $0 | $394.40 |
| 45 hours, $200 tips | $236.83 | $0 | $436.83 |

Ordinary tip pooling requires an employee vote
The state order allows ordinary pooling only among tipped employees and requires approval by 50% plus one of all tipped employees, with written voting records. This calculator excludes gaming and does not resolve whether someone with supervisory duties qualifies under both state and federal restrictions. § 46-02-07-03 pooling rules.
Paid breaks and jobsite travel change the hours to enter
The order generally requires a 30-minute meal break for a shift over five hours when two or more employees are on duty, subject to its waiver and agreement provisions. A meal can be unpaid only when the employee is completely relieved of duties. Travel between jobsites is work time; an ordinary home-to-work commute generally is not. § 46-02-07-02 working-time rules.
For example, five days with eight on-site hours plus half an hour of required travel between jobsites each day total 42.5 working hours. At the full floor, ordinary weekly gross is $317.19. Omitting that travel would produce $290 and miss $27.19.
Distinguish worked hours from paid leave
A week with 36 worked hours and eight paid leave hours has 36 hours toward ordinary overtime. The tool calculates the work portion; add leave pay separately under the applicable agreement. Forty-four actual working hours instead produce $333.50 at the full floor. Weekly overtime and leave FAQ.

Compare part-year work with year-round employment
Thirty-two hours for 40 weeks gives $9,280 at the full minimum. Forty hours for 52 weeks gives $15,080. A repeated 42.5-hour week gives $16,493.88 after weekly rounding. Actual annual pay will differ when schedules, retained tips or weeks worked change.
