The $500,000 exception is for retail or service businesses

The state employee definition excludes employment by a retail or service business with annual gross sales or business volume below $500,000. It is not a blanket exemption for every small employer in every industry, and exactly $500,000 is not below the threshold. The federal-only option requires an established state exemption and separate federal coverage; it is not selected automatically from a revenue entry. § 290.500(3)(m); DOL small-business FAQ.

For example, federal individual coverage can depend on what the employee does even where enterprise coverage is absent. If neither wage law covers a job, this tool does not establish a legal floor for it. Federal enterprise and individual coverage.

Most overtime starts after 40; a specific recreation rule uses 52

Missouri’s ordinary rule requires 1.5 times the regular rate after 40 hours. Section 290.505 separately requires overtime after 52 hours for an amusement or recreation business meeting the criteria in 29 U.S.C. § 213(a)(3). The category is narrower than “seasonal job.” Select it only after the statutory exemption and state coverage are confirmed. Missouri overtime statute.

Tipped cash and the employer’s make-up payment

At 40 hours, the $7.50 service cash floor gives $300 before adjustment. With $200 retained tips, the employer adds $100: $400 cash plus $200 tips equals $600. With $400 tips, cash remains $300 and gross is $700. Section 290.512 requires the employer to cover a deficiency in the combined minimum. State gratuity provision.

For 45 ordinary covered hours with $400 tips, employer cash is $375 and combined gross is $775. At 60 hours under the qualifying recreation rule with $500 tips, cash is $510 and gross is $1,010. The maximum credit stays $7.50 per hour, including premium hours; overtime is based on the full regular rate before the credit. Federal tipped-wage calculation.

Use the amended wage law, not an old inflation forecast

The current version of § 290.502 took effect August 28, 2025. It sets the January 2026 increase to $15 and ends the earlier annual CPI adjustment language at December 31, 2024. It also brings public employers within that section beginning August 28, 2025. The reviewed model keeps that enacted fixed floor through December 2027 and adds no hypothetical inflation increase. Gross annual earnings at the ordinary floor

A 40-hour schedule repeated for 52 weeks yields $31,200, averaging $2,600 monthly before taxes. A 30-hour schedule for 40 weeks yields $18,000. The annual result repeats one weekly scenario; it does not imply that an employer guarantees hours or that a state-exempt job owes the $15 rate.
